Will writing

We offer a service to help you draw up a Will. We’re committed to making sure that your Will properly expresses your wishes, and also that your assets are divided as you see fit.

A carefully drafted Will helps to ensure that your estate passes to the right people in a tax-efficient manner. We will plan your Will such that as much of the estate as possible passes to your chosen beneficiaries rather than the taxman. This is important because if your estate passes to a child, and their share is worth more than the individual Inheritance Tax nil-rate band, they could be liable to pay 40% tax on anything over that amount.

Will reviews

In addition to drawing up a Will on your behalf, we also offer a service to review Wills that have already been written. Your life is always changing and it’s important to keep your Will updated to reflect changes in circumstances, such as getting married or divorced, having children, selling a business or buying a new home.

Keeping your Will updated is the best way to ensure your loved ones are looked after when you die, as well as mitigating any Inheritance Tax that’s payable. At Wellesley Legal Services, we’ll highlight the options available to you, and the best way forward if your Will does need changing.

Acting as Executors

We can also act as your Executor – ensuring your loved ones will be well looked after in the future, and giving you some much-needed peace of mind today. Appointing a professional will ease the administrative burden on your loved ones, and give them the reassurance that your estate will be administered competently and efficiently.

As professional executors, we know the process that needs to be undertaken and will ensure that the Will is executed correctly and your final wishes carried out. This includes making sure that the financial planning we have put in place for you is implemented as planned – for example, any actions to mitigate your estate’s Inheritance Tax bill.

Probate

Probate is the legal process that takes place after someone dies – a grant of probate confirms the authority to deal with someone’s property, money and possessions (i.e. their estate) after they have died.

Probate can often be a complicated process, and the resulting stress is often compounded by the strong emotions having lost a loved one. We can support you through probate, sorting out the Will and finances after someone has passed away. Our team of specialists will guide you through each step of the probate process, including helping you apply for a grant of probate, dealing with HMRC and valuing the person’s estate.

Lasting powers of attorney

A Lasting Power of Attorney (LPA) is a way of planning ahead to ensure future financial security. This legal document allows you to formally appoint someone you trust to make decisions on your behalf if you become incapable, or simply no longer wish to.

A property and financial affairs LPA provides you with peace of mind that someone you trust – such as a relative or professional – is acting in your best interests. It doesn’t just offer protection for later life, but also in the case of an accident or illness that renders you incapable of making important financial decisions.
